Risk Warning, Assumption of Risk & Release
Risk warning. Physical exercise and training are recreational activities that carry inherent and obvious risks. These include muscle, joint and bone injury, aggravation of existing conditions, heat illness, cardiac events and, in rare cases, permanent disability or death. These risks cannot be fully eliminated, even when a program is followed correctly.
1. What you acknowledge
By accepting this document during setup, you acknowledge and agree that:
- you have read and understood the risk warning above;
- you participate in training rendered through Calibr voluntarily and at your own risk, and you accept the inherent risks of physical training;
- Calibr HQ provides general fitness coaching only — it is not medical advice, and no program, screening or safety limit replaces the advice of a doctor who knows your circumstances;
- you have answered, and will keep answering, the PAR-Q health screening honestly, and you understand the screening and the platform’s safety limits depend on the accuracy of what you tell us;
- you will stop training immediately and seek medical advice if you experience chest pain or pressure, severe or unusual breathlessness, dizziness, fainting, or sharp or persistent pain — and in an emergency you will call 000;
- you are responsible for your training environment and equipment, including using appropriate loads, collars, spotters and technique.
2. Release and waiver
To the maximum extent permitted by law, you release Calibr HQ Pty Ltd, its officers, employees and contracted coaches from liability for any injury, loss or damage you suffer arising from the inherent risks of recreational physical training undertaken through the service, including to the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth) and equivalent state and territory provisions applying to recreational services.
This release does not apply to, exclude or limit:
- your consumer guarantees under the Australian Consumer Law that cannot lawfully be excluded;
- liability for reckless conduct, fraud, or gross negligence;
- any other liability that cannot lawfully be excluded or limited.
3. Athletes aged 16–17
Where the athlete is 16 or 17, the parent or guardian who provides consent confirms that they have read this document, accept it on the minor’s behalf to the extent the law permits, and will supervise the minor’s decision to train. Stricter safety limits apply to minors’ programs automatically.
4. Relationship to our other terms
This document forms part of the Terms of Service. Nothing in it reduces our own safety obligations: platform safety limits, health screening gates and content rules apply regardless of this release. Questions: support@calibrhq.com.
