Terms of Service
These terms are an agreement between you and Calibr HQ Pty Ltd (“Calibr”, “we”, “us”), an Australian company. They govern your use of the Calibr website, apps and services. By creating an account, ticking the consent box during setup, or using Calibr, you agree to these terms. If you do not agree, do not use Calibr.
1. What Calibr is — and is not
Calibr is a subscription marketplace for general fitness and performance coaching. Coaches publish adaptive training programs; when you subscribe, your workouts are rendered to your own confirmed fitness baselines.
Calibr is not a medical, diagnostic, rehabilitative or emergency service. It does not provide medical advice, physiotherapy, injury treatment, clinical nutrition or crisis support, and it is not a substitute for a doctor or other health professional. In an emergency call 000.
2. Eligibility
- Calibr is offered to people located in Australia.
- You must be at least 16 years old to hold an account.
- If you are 16 or 17, a parent or guardian must provide consent that we can verify before you can record health information, receive rendered training targets or subscribe. See the Privacy Policy for how we handle a minor’s information.
- You must provide accurate account information, including your real date of birth.
3. Health screening and your safety obligations
Before Calibr renders personalised training targets you must complete the PAR-Q health screening honestly and keep it current. You agree to:
- answer health-screening questions truthfully and update us when your health changes;
- stop training and seek medical advice if you experience pain, dizziness, chest discomfort, unusual breathlessness or any other warning sign;
- obtain clearance from a doctor before training where your screening is flagged, and follow any restriction we apply to your program; and
- read and accept the Risk Warning, Assumption of Risk & Release, which forms part of these terms.
4. Subscriptions, trials and renewal
- Prices are shown in Australian dollars and include GST. The current price is displayed at checkout before you pay.
- New subscribers receive a 7-day free trial, once per canonical email identity. Changing letter case or adding a
+tagdoes not create another trial. If you do not cancel before the trial ends, your paid subscription starts automatically and your payment method is charged. - Subscriptions renew automatically — monthly plans each month, annual plans each year — until you cancel.
- You can cancel at any time from your plan page or by contacting support@calibrhq.com. Cancellation takes effect at the end of the current billing period; you keep access until then.
- You may have one active coach subscription at a time, and may switch coaches as described in the app.
- Payments are processed by Stripe. Calibr HQ Pty Ltd is the seller of record.
5. Refunds and your Australian Consumer Law rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under law that cannot lawfully be excluded.
- If there is a major failure with the service you are entitled to cancel and receive a refund for the unused portion, or to compensation for its reduced value.
- If the failure is not major, we will fix the problem within a reasonable time or, if we cannot, you may cancel and receive a refund for the unused portion.
- We do not otherwise offer refunds for change of mind for a billing period that has already started — the free trial and period-end cancellation exist so you can try Calibr and leave without being charged further.
To seek a remedy, contact support@calibrhq.com.
6. Coaches and program content
- Programs are authored by independent coaches, not by Calibr. Coaches are responsible for the content of their programs; Calibr HQ applies platform-level safety limits to rendered targets and moderates content against our policies.
- Coaches must not provide medical advice, diagnosis or injury treatment through Calibr, and no program may promise guaranteed results.
- Training results depend on many factors; we and our coaches do not guarantee any particular outcome.
- Coaches are bound by the Coach Terms.
7. Acceptable use
You must not:
- misrepresent your identity, age or health information;
- share your account or another person’s health information without authority;
- copy, scrape, resell or redistribute program content outside the service;
- harass or abuse other users or coaches, or post unlawful content in chat;
- interfere with the operation or security of the service.
We may suspend or terminate accounts that breach these terms. Where practical we will warn you first.
8. Intellectual property
Calibr and its coaches retain all rights in the service and program content. We grant you a personal, non-transferable licence to use content made available to you through your subscription, for your own training only. You retain ownership of the information you submit; you grant us the rights needed to operate the service, as described in the Privacy Policy.
9. Privacy
Our Privacy Policy explains what we collect (including your health information, with your express consent), how it is stored in Australia, and your rights to access, correct, export and delete it. You can delete your account at any time at calibrhq.com/account/delete or from within the app.
10. Liability
Physical training carries inherent risk. The Risk Warning, Assumption of Risk & Release sets out that risk and your acknowledgement of it.
To the extent permitted by law — and subject always to the ACL consumer guarantees, which are not excluded — our liability for a failure of the service is limited, at our option, to resupplying the service or paying the cost of having it resupplied, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for significant personal injury caused by reckless conduct.
11. Changes to the service or these terms
We may update the service and these terms. If a change to these terms is material we will notify you (for example by email or in-app notice) and, where the change affects your consents, ask you to re-accept before it applies to you. The current version and its effective date always appear at the top of this page.
12. Governing law and disputes
These terms are governed by the laws in force in New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales and of the Commonwealth of Australia. Please contact us first — most issues are resolved quickly at support@calibrhq.com. You may also contact your local fair trading office or the ACCC.
